The End of Mandatory Eviction Mediation in Whatcom County

As of June 30, 2023, the Eviction Resolution Pilot Program (ERPP) in Washington State, including Whatcom County, has concluded. This change means landlords are no longer required to offer tenants the option to participate in mediation before initiating eviction proceedings for unpaid rent
Background on the Eviction Resolution Pilot Program
The Eviction Resolution Pilot Program was a statewide initiative launched in November 2021 to address the surge in eviction cases during the COVID-19 pandemic. In Whatcom County, the program was administered by the Whatcom Dispute Resolution Center. It aimed to facilitate communication between landlords and tenants, offering mediation services to resolve disputes over unpaid rent without resorting to court proceedings.
During the course of the Pilot Program, the Whatcom Dispute Resolution Center handled over 2,400 cases, directly assisting more than 3,770 clients. Notably, 95% of cases where tenants engaged with the program reached a resolution, with nearly 90% avoiding formal eviction filings.
What Happens Now?
With the expiration of the Whatcom Dispute Resolution Center, landlords in Whatcom County are no longer mandated to provide tenants with an Eviction Resolution Pilot Program Notice or offer mediation before filing an unlawful detainer (eviction) action for nonpayment of rent.
Nonetheless, the Whatcom Dispute Resolution Center continues to offer voluntary Housing Stability mediation services. These services are available to both landlords and tenants seeking to resolve housing-related conflicts amicably.
